Privacy Concerns Around Microsoft Copilot: What Microsoft Actually Said

Microsoft Copilot has become one of the most talked-about AI tools in the enterprise world. Embedded deep within the Microsoft 365 ecosystem — across Word, Excel, Outlook, PowerPoint, Teams, and more — it promises to transform how people work. But with great capability comes great scrutiny, and the privacy questions surrounding Copilot have only grown louder as adoption has expanded. Here’s a clear-eyed look at what the concerns actually are and, crucially, what Microsoft itself has said about them.

The Core Privacy Debate

At its heart, the privacy concern around Microsoft Copilot boils down to one uncomfortable reality: a powerful AI assistant with access to your emails, documents, chats, and calendar is, by definition, reading deeply into the most sensitive corners of your digital life. Copilot works by tapping into Microsoft Graph — the backend layer that connects all of your Microsoft 365 content — and uses that data to generate responses, summaries, and drafts.

For most individual users, this feels convenient. For enterprises handling regulated data, government agencies, healthcare organizations, or legal firms, it raises serious questions about who can access what, where data goes, and whether automated processing of sensitive content could result in inadvertent disclosure.

What Microsoft Has Officially Stated

Microsoft has been deliberate in its public communications about how Copilot handles data. On its official documentation pages, the company makes several key commitments:

Your data does not train the model. Microsoft has stated clearly that prompts, responses, and data accessed through Microsoft Graph are not used to train its foundation large language models, including those powering Copilot. This is a significant assurance, as one of the biggest fears around enterprise AI is that confidential business information could seep into a model’s training corpus and later surface in responses to other users.

Data residency is honored. Microsoft 365 Copilot was added as a covered workload in the data residency commitments in Microsoft Product Terms on March 1, 2024. For EU customers, Microsoft 365 Copilot is classified as an EU Data Boundary service, ensuring that European customer data stays within EU boundaries.

Compliance with major regulations. Microsoft states that Copilot complies with GDPR, CCPA, and other major data protection frameworks. User data is not used to train machine learning models, data is encrypted both in transit and at rest, and Microsoft Copilot follows existing data permissions and policies, meaning users only see responses based on data they personally have access to.

Access is tied to user permissions. Microsoft has emphasized that Copilot doesn’t override existing access controls. If an employee doesn’t have permission to view a particular document or email thread, Copilot cannot surface it for them either. The AI is bounded by the same role-based permissions that already govern the organization’s data environment.

The Recall Controversy

No discussion of Copilot privacy would be complete without addressing Recall — the feature that arguably generated the most public backlash. Recall was designed to take continuous screenshots of a user’s screen and store them locally, allowing Copilot to help users search back through their own activity. Critics called it surveillance by design. In June 2024, in direct response to the backlash, Microsoft decided to make Recall an opt-in function rather than enabling it by default.  It was a notable retreat for the company, signaling that it had underestimated how viscerally people would react to an AI that essentially photographed everything they did on their computer.

The Confidential Email Bug: A Real-World Failure

Microsoft’s assurances sound reassuring on paper, but reality has not always cooperated. In early 2025, a significant bug in Microsoft 365 Copilot Chat came to light. The flaw, first detected on January 21 and tracked as CW1226324, allowed Copilot’s work tab chat feature to read and summarize emails stored in users’ Sent Items and Drafts folders, including messages protected by sensitivity labels meant to restrict automated access.

Microsoft acknowledged the problem directly. The company stated: “We identified and addressed an issue where Microsoft 365 Copilot Chat could return content from emails labelled confidential authored by a user and stored within their Draft and Sent Items in Outlook desktop.” Microsoft added: “While our access controls and data protection policies remained intact, this behaviour did not meet our intended Copilot experience, which is designed to exclude protected content from Copilot access.

The bug is significant not because it represented a fundamental design flaw in Microsoft’s approach, but because it demonstrated that even well-intentioned privacy guardrails can fail at the code level. Organizations that relied on sensitivity labels and data loss prevention policies discovered that these controls were not infallible in practice.

Government and Institutional Pushback

Microsoft’s privacy commitments have not been enough to satisfy every institution. The U.S. House of Representatives banned congressional staff from using Copilot due to concerns about data security and the potential risk of leaking House data to unauthorized cloud services.  Similarly, the European Parliament’s IT department reportedly blocked built-in AI features on staff devices, citing concerns that AI tools could upload confidential correspondence to the cloud.

Microsoft clarified that Copilot for Microsoft 365 operates within tenant boundaries and complies with enterprise-grade security controls, yet the ban reflected broader caution among public-sector entities toward AI deployment.  In other words, even technically compliant tools can face adoption barriers when the political stakes around data sovereignty are high.

The Over-Permissioning Problem

One systemic concern that Microsoft’s documentation doesn’t fully resolve is the issue of poor permission hygiene within organizations. Copilot’s access is bounded by user permissions — but in many enterprises, those permissions are far too broad to begin with. According to Microsoft’s own 2023 State of Cloud Permissions Report, less than 1% of granted permissions are actually used. If an employee has been granted access to files far beyond what their role requires, Copilot will treat all of that as fair game. The AI didn’t create the oversharing problem, but it can dramatically amplify its consequences.

The Bottom Line

Microsoft has made meaningful commitments: no model training on your data, encryption in transit and at rest, regional data residency, and compliance with GDPR. These are not trivial assurances. But the confidential email bug, the Recall controversy, the U.S. Congressional ban, and ongoing researcher-documented vulnerabilities all illustrate that the gap between stated policy and real-world behavior remains a genuine concern. Privacy in the age of AI copilots isn’t just a matter of terms and conditions — it’s a living, evolving challenge that requires constant vigilance from both the vendors building these tools and the organizations deploying them.
